Terms for Digital Sellers

These Terms for Digital Sellers (“Seller Terms”) govern the sale of digital products on Elokise. By uploading, listing, or selling digital products on Elokise, you agree to comply with these terms.

If you do not agree, you may not sell digital products on the platform.

 

1. Eligibility to Sell

To sell digital products on Elokise, you must:

  • Be at least 18 years old or have legal guardian consent
  • Provide accurate and truthful account information
  • Have the legal right to sell the digital products you upload
  • Elokise reserves the right to approve, suspend, or remove seller accounts at its discretion.

 

2. What You Are Allowed to Sell

You may sell original digital products, including but not limited to:

  • eBooks, guides, and written materials
  • Templates and digital documents
  • Educational content and digital courses
  • Design assets and creative resources
  • Checklists, planners, and productivity tools
  • All products must be digital-only. Physical goods are not allowed.

 

3. Prohibited Content

You may not sell:

  • Stolen, copied, or copyrighted content you do not own
  • Content that infringes intellectual property rights
  • Adult, explicit, illegal, or harmful material
  • Misleading, false, or deceptive products
  • Products that promote fraud, hate, or violence
  • Elokise has zero tolerance for unlawful or unethical content.

 

4. Ownership & Intellectual Property

  • You retain ownership of your digital products.
  • By uploading content, you grant Elokise a non-exclusive licence to host, display, and distribute your product for sales and marketing purposes.
  • You are fully responsible for the legality and originality of your content.
  • Elokise does not claim ownership of your products.

 

5. Pricing & Payments

  • You are responsible for setting your own prices.
  • Elokise may charge a platform commission or service fee, which will be disclosed clearly.
  • Payments are processed through approved third-party payment providers.
  • Payouts are subject to payment processor timelines and verification requirements.
  • Elokise is not responsible for delays caused by payment providers.

 

6. Refunds & Disputes

Due to the nature of digital products, refunds are limited.

Refunds may be issued in cases of:

  • Duplicate purchases
  • Technical delivery failure
  • Proven misrepresentation

Elokise reserves the right to investigate disputes and make final decisions.

 

7. Seller Responsibilities

As a seller, you agree to:

  • Provide accurate product descriptions
  • Deliver high-quality and functional digital files
  • Respond professionally to reasonable customer inquiries
  • Update or remove products that are outdated or incorrect

Failure to meet these responsibilities may result in account suspension or removal.

 

8. Platform Rights

Elokise reserves the right to:

  • Review, approve, reject, or remove any product
  • Suspend or terminate seller accounts for violations
  • Update these Seller Terms at any time

Continued use of the platform means you accept any updated terms.

 

9. Limitation of Liability

Elokise acts as a platform provider and is not responsible for:

  • The content or quality of seller products
  • Loss of income, data, or reputation
  • Disputes between buyers and sellers

Sellers indemnify Elokise against claims arising from their products.

 

10. Legal & Compliance

  • Sellers are responsible for complying with applicable South African laws, including tax obligations.
  • Sellers must ensure compliance with POPIA when handling personal data.

 

11. Termination

  • You may stop selling at any time by removing your products.
  • Elokise may terminate accounts that violate these terms without prior notice.
